Gingerbread Workshop Terms & Conditions

1. Scope

These Terms and Conditions apply to all bookings for workshops and related services offered by Bitesize by Casey.

Any different or additional terms proposed by a customer apply only if expressly accepted by Bitesize by Casey in writing.

2. Workshop enquiries and bookings

Submitting an enquiry does not create a binding booking.

A booking becomes binding when the customer accepts a written offer or booking confirmation issued by Bitesize by Casey. The confirmation will specify the workshop date, location, package, number of participants, price and any individually agreed services.

The person making the booking confirms that they are authorised to book on behalf of the named company, organisation or group.

3. Workshop packages

The services included in each package are described in the individual offer or booking confirmation.

Unless otherwise agreed, every workshop includes:

• Pre-baked gingerbread-house pieces

• Royal icing and decorating materials

• The necessary workshop tools

• Guidance throughout the workshop

• The refreshments, food or drinks included in the selected package

Images and examples displayed on the website are illustrative. Individual creations, decorations and materials may vary according to availability.

4. Participant numbers

Workshops are generally available for groups of 8–15 participants, unless otherwise agreed in writing.

The final number of participants must be confirmed no later than 14 days before the workshop.

The customer will be charged for the confirmed number of participants, even if fewer people attend. Additional participants are subject to availability and must be approved in advance.

5. Prices and VAT

The applicable price is stated in the written offer or booking confirmation.

Unless otherwise stated, prices include the workshop materials and the services listed in the selected package.

Bitesize by Casey currently applies the Austrian small-business VAT exemption. No VAT is charged pursuant to § 6 Abs. 1 Z 27 UStG.

Any additional services requested by the customer may be charged separately.

6. Payment

A deposit of 50% of the estimated total booking price is due within 14 days of the deposit invoice. Unless otherwise agreed in writing, the booking is secured once the deposit has been received.

The remaining balance will be invoiced following the workshop and is payable within 14 days of the invoice date.

The final participant number must be confirmed no later than 14 days before the workshop. The final invoice will be based on the confirmed number of participants or the number who actually attend, whichever is higher.

Where a company’s internal purchasing procedures do not permit advance payment, alternative payment arrangements may be agreed in writing before the booking is confirmed. Bitesize by Casey may request an official purchase order or other written confirmation of the company’s payment commitment.

Invoices are payable by bank transfer to the account stated on the invoice. Any additional services or participants approved after the booking confirmation will be included in the final invoice.

In the event of late payment, the statutory provisions concerning default interest and recovery costs apply.

7. Cancellation by the customer

Cancellations must be submitted in writing by email. The date on which Bitesize by Casey receives the cancellation determines the applicable cancellation charge.

Unless otherwise agreed in writing, the following cancellation charges apply:

• More than 28 days before the workshop: no cancellation charge, except for non-recoverable venue, catering, production or supplier costs already incurred specifically for the booking

• Between 14 and 28 days before the workshop: 50% of the agreed total booking price

• Fewer than 14 days before the workshop: 100% of the agreed total booking price

Any deposit already paid will be credited against the applicable cancellation charge. If the deposit exceeds the amount payable, the remaining balance will be refunded. If the cancellation charge exceeds the deposit, the outstanding amount will be invoiced and is payable within 14 days.

The customer may request to reschedule the workshop instead of cancelling it. Rescheduling is subject to availability and must be agreed in writing. Where rescheduling is accepted, the deposit may be transferred to the new date; however, any additional or non-recoverable costs resulting from the change remain payable by the customer.

The final number of participants must be confirmed no later than 14 days before the workshop. A reduction in participant numbers after this deadline will not reduce the agreed booking price.

8. Cancellation or changes by Bitesize by Casey

Bitesize by Casey may make reasonable changes to the workshop where necessary, including replacing unavailable ingredients, decorations, refreshments or catering items with suitable alternatives.

If a workshop must be cancelled due to illness, venue problems or another circumstance within the reasonable control of Bitesize by Casey, the customer may choose between:

• Rescheduling the workshop to an available alternative date; or

• Receiving a refund of the workshop fees already paid

Bitesize by Casey is not responsible for additional costs incurred by participants, such as travel or accommodation expenses.

9. Force majeure

Neither party is responsible for failure or delay caused by circumstances beyond its reasonable control, including severe weather, natural disasters, government restrictions, epidemics, transport disruption, strikes or the unexpected closure of the venue.

Where possible, the parties will attempt to reschedule the workshop. Costs already committed to external suppliers may remain payable where they cannot reasonably be recovered.

10. Food, ingredients and allergens

Gingerbread, icing, decorations, food and drinks may contain or come into contact with allergens, including gluten, eggs, milk, nuts, peanuts, soy and sulphites.

The customer must inform Bitesize by Casey of allergies, intolerances and dietary requirements at least two weeks before the workshop date.

Although reasonable efforts will be made to accommodate notified requirements, an allergen-free environment cannot be guaranteed. Participants with serious allergies should assess whether attending or consuming the products is appropriate for them.

11. Alcohol

Where alcoholic beverages are included in a workshop package, they are supplied and served exclusively by the venue or an appropriately authorised third-party provider. Bitesize by Casey does not sell, supply or serve alcoholic beverages.

The venue or third-party provider is responsible for complying with all applicable licensing, age-verification and alcohol-service requirements. Participants must comply with the venue’s rules and consume alcohol responsibly. The customer must inform participants in advance that alcohol may be available.

Bitesize by Casey may request that alcohol service be refused or discontinued where a participant’s behaviour could endanger themselves or others or disrupt the workshop. This does not replace the venue’s responsibility for deciding whether alcohol may legally and safely be served.

12. Participant conduct and safety

Participants must follow reasonable safety and venue instructions.

The customer is responsible for damage caused intentionally or negligently by members of its group. Bitesize by Casey may ask a participant to leave if their conduct is unsafe, disruptive, discriminatory or otherwise inappropriate. No refund will be provided in these circumstances.

Children may attend only where this has been agreed in advance and must remain under the supervision of a responsible adult.

13. Finished gingerbread creations

Participants may take their completed creations home after the workshop.

Because the creations are handmade and transported by participants, Bitesize by Casey cannot guarantee that they will remain undamaged after leaving the venue. Participants are responsible for the handling, storage and consumption of their creations.

14. Photography

Photographs or videos of participants will be used for marketing purposes only where the affected individuals have provided appropriate consent.

Participants may withdraw their consent for future use by contacting Bitesize by Casey. Withdrawal does not affect uses that occurred lawfully before consent was withdrawn.

Participants must respect the wishes and privacy of other guests when taking or sharing their own photographs.

15. Intellectual property

Workshop concepts, original gingerbread-house designs, stencils, instructional materials, photographs and other creative content provided by Bitesize by Casey remain protected by applicable intellectual-property law.

Materials are supplied for participants’ personal use during and after the workshop. They may not be reproduced, resold, commercially distributed or used to run competing workshops without prior written permission.

16. Liability

Bitesize by Casey is liable in accordance with applicable Austrian law.

Nothing in these Terms excludes or limits liability for personal injury, intentional misconduct, gross negligence or any liability that cannot legally be excluded.

To the extent legally permitted, liability for minor negligence is limited to breaches of essential contractual obligations and to reasonably foreseeable loss.

Participants are responsible for their personal belongings.

17. Consumer withdrawal rights

The statutory right of withdrawal generally applies only to consumers and not to customers booking a workshop for business or professional purposes.

Where a consumer books a workshop or event for a specific date or period, no statutory right of withdrawal applies pursuant to § 18(1)(10) FAGG, as the contract concerns a leisure-related service to be provided on a specified date.

Any right to cancel or reschedule a booking is therefore governed by the cancellation conditions set out in these Terms and Conditions. Mandatory statutory rights remain unaffected.

18. Data protection

Personal information is processed in accordance with the Bitesize by Casey Privacy Policy, available through the website footer.

19. Governing law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

For business customers, the competent court in Vienna is agreed as the exclusive place of jurisdiction.

For consumers, the mandatory statutory rules concerning jurisdiction remain unaffected.

20. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected. The invalid provision will be replaced by the applicable statutory rule.
